RUELLE Online Store Terms of Use
ROI Co., Ltd. (hereinafter referred to as "RUELLE") establishes the following Terms of Use (hereinafter referred to as the "Terms") regarding the services of the RUELLE Online Store (hereinafter referred to as the "Store") provided on the website operated by RUELLE (hereinafter referred to as the "Site"). By using the Store, the User is deemed to have agreed to the Terms.
Article 1: Purpose
The purpose of the Terms is to define the conditions for using the Store and the rights and obligations between the Company and the User. Users shall agree to and comply with the Terms when using the Store. The contract between the User and the Company shall be deemed formed at the time the User agrees to the Terms.
Article 2: Definitions
The following terms shall have the meanings set forth below: (1) "Contract": The usage contract between the User and the Company, governed by the Terms. (2) "User": Any individual or legal entity that uses the Store provided by the Company. (3) "Product(s)": Goods purchased by the User at the Store. (4) "Communication Devices": Terminal devices such as smartphones, tablets, and PCs. (5) "Anti-Social Forces, etc.": Organized crime groups and other similar entities.
Article 3: Service Content
The Store provides services allowing Users to purchase Products. Detailed terms of sale, payment, delivery, and other related matters shall be subject to the Terms and the procedures established by the Company.
Article 4: User Registration
To use the Store, Users must complete user registration by accurately entering the required information in accordance with the procedures established by the Company.
The Company may refuse or cancel registration if the registered information contains falsehoods, errors, or omissions, or if a relationship with Anti-Social Forces is identified. Users shall promptly notify the Company of any changes to their registered information.
Article 5: Management of IDs, Passwords, etc.
Users are responsible for managing their registered IDs and passwords and must not transfer or lend them to third parties.
Users bear responsibility for any damages resulting from unauthorized use by third parties; RUELLE shall not be held liable unless such damages arise from its willful misconduct or gross negligence.
Users must promptly notify RUELLE if unauthorized use is discovered.
Article 6: Scope of Application and Amendments to Terms
These Terms apply to all users of this Store. RUELLE may amend these Terms at any time without the prior consent of users, using methods deemed appropriate by RUELLE (such as via email or posting on this website).
Article 7: Conditions of Use
RUELLE may restrict or prohibit a user from using this Store if the user violates Article 5 or if RUELLE determines that the user has committed such a violation in the past.
Article 8: Prohibited Acts
Users must not engage in the following acts:
・ Reselling products or purchasing products for commercial purposes
・ Purchasing products for the purpose of overseas forwarding or resale (regardless of the destination country)
・ Using this Store by providing false information or the information of a third party
・ Unauthorized use of email addresses, passwords, credit card information, etc.
・ Acts that cause, or are likely to cause, nuisance, disadvantage, or damage to other users, third parties, or RUELLE
・ Acts that infringe, or are likely to infringe, upon the rights (trademark rights, copyrights, privacy, etc.) of other users, third parties, or RUELLE
・ Acts that violate public order and morals, laws, or regulations, or are likely to do so
・ Any other acts deemed inappropriate by RUELLE
Article 9: Handling of Personal Information
RUELLE shall handle users' personal information appropriately in accordance with the Privacy Policy established by RUELLE.
Article 10: Product Orders and Sales
Users may order products in accordance with these Terms and the procedures established by RUELLE.・This store conducts both standard sales and made-to-order sales; items sold on a made-to-order basis are clearly marked as such on their respective product pages. Delivery dates are estimates and are subject to change without prior notice.
・As production of made-to-order items begins after the order acceptance period ends, cancellations, returns, or exchanges due to customer preference are not accepted (except in the case of defective products).
Article 11: Formation and Termination of Contract
A sales contract for the product is deemed formed at the moment the user clicks the order completion button and the confirmation screen is displayed.
RUELLE may cancel an order or halt shipment without incurring liability to the user in the following cases:
・Out-of-stock or production is impossible
・Incorrect display due to system failure
・Actual inventory does not exist
・Inability to deliver due to incomplete delivery information or the user's prolonged absence
・The user fails to meet the conditions set forth in Article 7
・RUELLE determines that the user has violated, or is likely to violate, Article 8
・RUELLE determines that bulk purchases are intended for resale
・Any other case deemed inappropriate by RUELLE
Furthermore, RUELLE may terminate this contract and cancel the user's registration without prior notice in the following cases:
・False information was provided during registration
・The user has previously been subject to suspension of service or similar penalties
・Acts violating these Terms or applicable laws are discovered
・Payment delinquency or fraudulent activity has occurred
・Failure to respond to communications from the Company for five days or more
・Any other case deemed inappropriate by the Company
Article 12: Prices and Payment
Displayed prices generally include tax. If a price excludes tax, it will be marked as "excl. tax" or "+ tax."
In the event of an incorrect price display, RUELLE will take the following actions:
(1) If the actual price is lower than the displayed price: The item will be sold at the lower price.
(2) If the actual price is higher than the displayed price: The user will be contacted prior to shipment, and the order may be cancelled.
Payment methods shall be in accordance with those listed on this site, and the order is considered confirmed upon completion of payment. The use of coupons and points shall be subject to the conditions stipulated by RUELLE.
Article 13: Delivery
Product delivery is limited to locations within Japan and overseas regions supported by RUELLE. The user shall bear all costs associated with overseas delivery, including customs duties and clearance fees.
In principle, items in stock will be shipped within 2 to 5 business days after the order is completed. However, exceptions apply in the following cases:
・Year-end/New Year holidays, extended holidays, temporary closures, etc.
・Redelivery due to the recipient's absence, etc.
・Delays caused by force majeure such as weather, natural disasters, or traffic conditions
・Order volumes exceeding expectations or strain on the delivery system
・Cases where separate conditions are stated on the product page, etc.
・Pre-order items or restocked items
Article 14: Returns, Exchanges, and Cancellations
Returns and exchanges of standard products are accepted only if the request is made within 5 days of delivery, the product is unused, and all accessories are included.
Returns and exchanges are not accepted for made-to-order products, except in cases of defective items or incorrect delivery.
RUELLE shall bear the shipping costs for returning defective items, whereas the user shall bear the costs for returns due to user preference.
Article 15: Disclaimer
While RUELLE strives to ensure the accuracy and currency of the information posted on this store, it does not guarantee the content thereof.
Product colors, textures, and the like may differ from the actual items depending on the user's viewing environment (monitor, etc.).
RUELLE shall be deemed to have fulfilled its obligations by processing transactions based on the information registered by the user.
Article 16: Intellectual Property Rights
All content posted on this site—including logos, images, text, and designs—belongs to RUELLE or its licensors. Unauthorized use, reproduction, or modification is prohibited.
Article 17: Compensation for Damages
In the event that RUELLE incurs liability for damages in connection with the use of this store, such liability shall be limited to the purchase price of the relevant product (except in cases of willful misconduct or gross negligence on the part of RUELLE). RUELLE shall not be liable for any damages arising from the unavailability of the Service or similar issues, except in cases of willful misconduct or gross negligence.
Article 18: Maintenance
To ensure the proper provision of the Store's services, RUELLE may temporarily suspend or discontinue the Service without prior notice in the following cases:
・During scheduled or emergency system maintenance
・When system operation becomes difficult due to natural disasters, war, infectious diseases, changes in laws or regulations, government orders, etc.
・When the system suffers a failure due to unauthorized access, virus infection, etc.
・When RUELLE otherwise determines that suspension of the Service is necessary due to unavoidable circumstances
Article 19: Governing Law and Jurisdiction
These Terms shall be governed by the laws of Japan. In the event of a dispute regarding the Store, the Osaka District Court shall have exclusive jurisdiction as the court of first instance.
